Version 2.0 — pre-launch phase (BSL-PRIVACY-REWRITE, 2026-07-03)
In compliance with Article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the identifying information of the provider of the Orixium service is set out below.
Holder: Dídac Odena Andújar, natural person resident in Spain, acting as founder of the Orixium project in pre-launch phase. The contact postal address and professional tax identification number will be published upon incorporation of a legal entity (limited company) or upon activation of professional invoicing through registration in the Special Regime for Self-Employed Workers (RETA), planned for Phase C of the launch plan (first real revenue). Until then, there is no legal obligation of registration in the Mercantile Registry nor of publication of fiscal address of activity, as the regulated economic activity has not commenced.

During the pre-revenue phase, the role of Data Protection Officer is held by the founder, with a commitment to appoint an independent Officer before reaching 250 active users or the opening of public beta. Contact channels are attended in writing during business hours in mainland Spain, and responses to communications are provided within a reasonable time depending on the nature of the inquiry.
Orixium is a pure software tool to create and validate algorithmic trading strategies through backtesting on historical data, with an honest statistical verdict on the results obtained. The service includes an AI copilot that helps build and understand strategies in the abstract, without recommending specific assets or personalizing based on the user's financial situation. Orixium does NOT execute real trades on any financial market or crypto-asset, does NOT emit real-time trading signals, does NOT manage third-party funds, does NOT custody funds or crypto-assets, and does NOT connect exchange or broker accounts on behalf of the user. All results shown by the service are hypothetical and simulated; they do not represent real trades executed in any market and do not guarantee future profitability.
Orixium does NOT provide any of the investment services listed in Annex I, Section A, of Directive 2014/65/EU (MiFID II): it does not execute orders on financial instruments, does not manage portfolios with discretion, does not provide personalized investment advice, and does not receive or transmit orders on behalf of third parties. The trigger for regulated investment advice under MiFID II is personalization of the recommendation — not merely naming a financial instrument — per ESMA's Supervisory Briefing of 11 July 2023 (ESMA35-43-3861) on the definition of advice. Orixium builds and validates strategies in the abstract, without recommending specific assets or personalizing based on the user's financial situation (see Privacy Policy, section 4), and therefore falls outside that perimeter by product design, not by a sector-wide exemption declared by ESMA for backtesting vendors. Orixium is NOT a Crypto-Asset Service Provider (CASP) under Regulation (EU) 2023/1114 (MiCA): it does not custody third-party crypto-assets, does not execute transactions on them, and does not provide any of the services listed in Article 3(1)(16) MiCA. Orixium is NOT a credit institution, payment institution, electronic money institution, nor is it subject to authorization by the Bank of Spain, the Spanish Securities and Exchange Commission (CNMV) or any other financial supervisory authority, and it does not hold the status of obligated entity under Spanish Law 10/2010 on the prevention of money laundering.
The service is governed by Spanish and European Union legislation, in particular: Spanish Law 34/2002 LSSI-CE, Regulation (EU) 2016/679 GDPR, Spanish Organic Law 3/2018 LOPDGDD, Spanish Royal Legislative Decree 1/2007 (General Law for the Defense of Consumers and Users), Regulation (EU) 2023/1114 MiCA where applicable, Directive 2014/65/EU MiFID II where applicable, Regulation (EU) 2024/1689 (EU AI Act) where applicable and concordant regulations. For dispute resolution between consumers and traders, users may access the European online dispute resolution platform available at https://ec.europa.eu/consumers/odr.
The use of the service is additionally governed by the following legal documents, accessible permanently from the application footer: Terms and Conditions, Privacy Policy, Cookie Policy and Investment Risk Disclaimer. In case of conflict between these documents, the one containing the obligation most protective of the user under applicable regulation shall prevail.
All contents of the Orixium service (code, graphic design, text, logos, trademarks and other elements) are the property of the holder or are used with authorization of the legitimate holder. Reproduction, distribution or transformation of such contents without express authorization is prohibited, except for personal use by the user within the framework of the service.
This Legal Notice may be modified to reflect changes in the project activity, in applicable legislation or in the legal structure of the provider (for example, upon incorporation of a limited company or registration as self-employed). Material changes will be communicated to registered users with at least 30 days notice.
