These Terms govern access to and use of the Orixium service, provided by Dídac Odena Andújar ("Orixium"), as a software tool to create and validate algorithmic trading strategies. Acceptance is made electronically at registration by explicit ticking of the consent checkbox. These Terms are complemented by the Privacy Policy, the Cookie Policy and the Investment Risk Disclaimer, all integral parts of the contractual framework. Orixium reserves the right to request additional acceptances upon new material versions of the service.
Orixium is a pure software tool to create and validate algorithmic trading strategies through backtesting and an honest statistical verdict. The service lets users build strategies (no coding required), run them against historical data, and obtain quantitative metrics with a diagnosis of whether the observed performance is statistically significant or the result of overfitting. Orixium does NOT execute real trades on any financial market, does NOT emit real-time trading signals, does NOT manage third-party funds, and does NOT constitute personalised investment advice. The user is solely responsible for any investment decision made based on the backtesting results. Hypothetical and simulated results have inherent limitations; see the Investment Risk Disclaimer for the full warnings framework.
The service is directed exclusively at natural persons over 18 residing in a European Union Member State. During the pre-launch phase, access may be additionally restricted per country for regulatory compliance purposes. Upon registration, the user declares to meet age, legal capacity and residence requirements, and that trading of financial instruments and crypto-assets is not prohibited by regulation in their jurisdiction. Orixium may at any time request identity, residence and age verification documentation when necessary to meet legal obligations or prevent abuse.
Using the service requires creating an account by providing a valid email address, a password and accepting the applicable legal documents. The user is responsible for maintaining the confidentiality of credentials, activating additional security mechanisms (such as two-factor authentication when available) and notifying Orixium of any unauthorized access. Orixium may suspend or cancel accounts when there are reasonable indications of impersonation, fraudulent use, breach of these Terms or applicable regulation.
All results generated by Orixium are hypothetical and simulated: they are computed against historical data using parameters fixed after the fact and do not represent real trades executed in any market. Past strategy performance does not guarantee future results. Metrics shown (win rate, Sharpe ratio, drawdown, return, etc.) are statistical estimates subject to the limitations of backtesting, including overfitting, survivorship bias and market conditions that may differ from historical data. Users must treat results as an analytical tool, not as a projection of profitability.
Orixium applies a freemium model: basic features (backtesting, honest verdict, limited strategies) are free; advanced features (unlimited strategies, result exports and additional analyses) require subscription to a premium plan. Orixium does NOT execute real trades under any circumstances or any plan. During the 30-day trial period, the user may access premium features at no charge, with the limitations described on the pricing page and in the Risk Disclaimer. At the end of the trial no automatic conversion to any paid plan occurs and no charge is generated: the user reverts to the limited free tier unless they expressly activate a paid plan from Settings. The 14-day withdrawal period provided for in Spanish Law 3/2014 (Art. 102) starts counting from the first effective charge, not from trial activation, since the trial is free and does not create an onerous contract. Billing is managed by an external payment provider; specific charging, renewal and withdrawal rights are detailed in the contracting flow.
Orixium provides the service without any guarantee of profitability. To the maximum extent permitted by law, Orixium is not liable for patrimonial losses arising from user investment decisions, adverse market movements, third-party infrastructure failures (data providers, infrastructure and service providers) or inaccuracies in the historical data used for backtesting. The limitations in this section do not exclude liability for wilful misconduct, gross negligence or damages caused to consumers under Royal Legislative Decree 1/2007 (TRLGDCU). The user may close their account at any time from platform settings or by sending a request to [email protected]. Orixium may suspend or cancel accounts upon breach of these Terms, fraudulent use, security risks or legal requirements. After closure, data is retained for a 30-day grace period and subsequently pseudonymized or deleted except for legal retention obligations (5 years MiCA, 6 years Commercial Code for operational records).
Orixium may modify these Terms to reflect regulatory, technical or service changes. Material changes will be notified to the user at least 30 days in advance via email or platform notice, and new acceptance will be requested where necessary. Continued use of the service after the effective date of changes implies tacit acceptance of the new version.
These Terms are governed by Spanish law and, where applicable, by European Union law (MiCA, MiFID II, GDPR, DSA, LSSI-CE). For resolution of any dispute arising from these Terms, the parties submit to the competent Courts and Tribunals under applicable consumer regulation; consumer users retain the right to bring proceedings in the courts of their habitual residence under Regulation (EU) 1215/2012. Pursuant to Directive (EU) 2025/2647, Orixium participates in Alternative Dispute Resolution (ADR) for consumer disputes; the designated ADR entity will be published before launch. Prior claims may be addressed to [email protected], which will respond within 14 business days. The European Online Dispute Resolution (ODR) platform previously available at ec.europa.eu/consumers/odr was discontinued between 2024 and 2025; any new European digital dispute resolution tools will be published here when they come into force.
